Rape is non-consensual sexual intercourse that is committed by physical force, threat of injury, or other duress.

Consent plays a vital role in any rape case. A person can give consent initially but later withdraw that consent. Further, if a person is too intoxicated to give consent, if they have a mental or physical incapacity, or were asleep or unconscious, that person is deemed unable to give consent.

The punishment for rape varies depending on whether the victim was a minor or not. As in other sex offense cases, the crime of rape would require registration as a sex offender.
