Unlawful Sexual Intercourse with a Person Under 18

Statutory rape occurs when a person engages in sexual intercourse with a person under the age of 18. For example, if a couple engages in intercourse but the boyfriend is 19 years old and the girlfriend is 16 years that would be considered statutory rape. Although consensual, because of the age difference the sexual act is considered to be against the law. In California the consenting age is 18 years old.
